1. Acceptance of Terms

By accessing or using the Pecorino application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Pecorino Foods LLC ("Pecorino," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using Pecorino, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. Accounts

To use most features of the Service, you must sign in with a Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Pecorino account. You agree to notify us promptly if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if you violate these Terms or if your use of the Service poses a risk to Pecorino, other users, or third parties.

4. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Harass, abuse, or harm other users.
• Scrape, crawl, or use automated means to access the Service without our prior written consent.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Attempt to circumvent any security measures or access controls.
• Interfere with or disrupt the Service or the servers and networks connected to it.
• Upload content that infringes the intellectual property rights of others.

5. AI-Generated Content

Pecorino uses third-party AI services to generate recipes, suggestions, and other content. AI-generated content is provided for informational purposes and may not always be accurate, complete, or suitable for your specific needs.

• No guarantees. We do not warrant the accuracy, safety, or nutritional correctness of any AI-generated recipe or recommendation. Always use your own judgment when cooking, especially regarding allergens, food safety, and dietary needs.
• Not medical or nutritional advice. AI-generated content does not constitute professional dietary, medical, or nutritional advice. Consult a qualified professional for specific dietary needs.
• Third-party processing. Your content may be processed by third-party AI providers as described in our Privacy Policy.

6. Your Content

You retain ownership of the recipes, photos, videos, messages, and other content you create or upload to the Service ("Your Content"). By using the Service, you grant Pecorino a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process Your Content solely for the purpose of operating and improving the Service.

This license ends when you delete Your Content or your account, except where Your Content has been shared with other users (for example, within a household) and they have not also deleted it.

You represent that you have the right to upload any content you submit and that Your Content does not violate any third party's rights.

7. Pecorino's Intellectual Property

The Service—including its design, code, features, logos, and branding—is owned by Pecorino Foods LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Pecorino's name, logos, or branding without our prior written consent.

8. Third-Party Services

The Service integrates with third-party services such as Google (for authentication and AI processing) and may allow connections to additional tools. Your use of third-party services is subject to their own terms and privacy policies. Pecorino is not responsible for the practices of any third-party service.

9. Termination

You may stop using the Service and delete your account at any time from within the app. Upon account deletion, your data will be permanently removed within 30 days as described in our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy or completeness of any content generated by or available through the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Pecorino Foods LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred dollars (US $100), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pecorino Foods LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Dispute Resolution

Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. If this waiver is found to be unenforceable, the entirety of this arbitration provision shall be void.

Exceptions. Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the most recent revision.
